This website (whitsellstacoma.com) is operated by Whitney Lumsden, a licensed Washington State real estate broker (WA DOL License #21022880) affiliated with eXp Realty — Olympia, WA branch. In this policy, "I," "me," and "my" refer to Whitney Lumsden. "You" means the visitor using the site.

2. Information I Collect
Information you give me directly
- Lead and contact forms: first name, last name, email address, phone number (optional), budget range, buying timeline, and the property page you requested details on.
- Referrals and scheduling: any information you share when referring a friend, booking a call, or asking for a home valuation.
- Correspondence: messages, attachments, or notes you send me by email, text, or through the site.
Information collected automatically
- Usage and device data: IP address, browser type, approximate location (city/region), device type, referring URL, and pages viewed.
- Cookies and similar technologies: small data files your browser stores so the site remembers your cookie-consent choice, session state, and any analytics preferences you opt into.
3. How I Use Your Information
- Respond to home-tour requests, showing inquiries, and general questions.
- Send property details, similar listings, and real estate education through email (MailerLite).
- Match you with a trusted lender, inspector, or other service provider if you ask for a referral.
- Improve the site — which pages are useful, which broken links need fixing, how long pages take to load.
- Meet legal, regulatory, and tax obligations as a Washington real estate broker.
4. Cookies & Tracking Technologies
On your first visit you will see a cookie banner that lets you accept all cookies, reject non-essential cookies, or open a preferences panel. You can reopen that panel any time by clicking the Privacy pill in the bottom-left of any page.
I use four categories of cookies:
- Essential — required for the site to load, remember your consent choice, and secure lead form submissions. These are always on.
- Analytics — help me see which pages and neighborhoods visitors find useful. These are only set if you opt in.
- Marketing & Email — allow me to follow up on inquiries through MailerLite and send relevant property emails. Only set if you opt in.
- Do Not Sell or Share — turning this on tells the site not to share personal data with third parties for cross-context behavioral advertising. I do not sell personal information.
5. How I Share Information
I do not sell your personal information. I share it only with the following categories of recipients, and only to do the things you asked me to do:
- Service providers I use to run my business — e.g. MailerLite (email delivery), my brokerage eXp Realty, Google (fonts and maps embeds), Calendly (scheduling), and my website host. These providers are contractually limited to using your data only to provide their service to me.
- Transaction partners when you ask me to work with them on your behalf — your lender, title company, inspector, or another licensed real estate agent you are being referred to.
- Legal and safety — if required by law, subpoena, or to protect the rights, property, or safety of any person.
6. How Long I Keep Your Information
I keep lead and client records for as long as you remain an active contact plus the minimum retention period Washington real estate brokers are required to keep records (generally three years from the date of the last transaction or communication). You can ask me to delete your record at any time (see Section 8).
7. How I Protect Your Information
My site is served over HTTPS, lead form submissions are transmitted over TLS, and I limit who at my brokerage can see your details. No method of transmission over the internet is 100% secure, so I cannot guarantee absolute security.
8. Your Privacy Rights
California residents (CCPA / CPRA)
If you are a California resident, you have the following rights with respect to your personal information:

EU / UK residents (GDPR)
If you are in the European Economic Area or the United Kingdom, you have the right to access, rectify, erase, restrict, object to, and port your personal data, and to lodge a complaint with your local supervisory authority. I rely on the following legal bases: consent (marketing email, analytics), contract (responding to your inquiry), and legitimate interests (site security and administration).
Washington residents
Washington's My Health My Data Act and Consumer Protection Act give you rights to transparency and limits on the processing of sensitive consumer data. This site does not collect health data or other categories of sensitive data covered by those statutes.
9. Do Not Sell or Share My Personal Information
I do not sell personal information. To the extent that my embedded tools (e.g. Google Maps, YouTube videos) may constitute "sharing" under CCPA/CPRA, you can opt out by:
- Opening the cookie preferences panel and toggling Do Not Sell or Share my Personal Information on, or
- Sending an opt-out request to whitneylumsden.realtor@gmail.com.
My site honors the Global Privacy Control (GPC) signal where detected.
10. Third-Party Links & Embeds
Some pages embed content from third parties (Redfin listing photos, YouTube walkthrough videos, Google Maps location previews, Calendly scheduling). Those third parties have their own privacy policies. I do not control their practices.
11. Real Estate Advertising Disclosures
All listing information on this site is believed to be reliable but is not guaranteed and should be independently verified by the buyer. Each property's listing agent and brokerage is disclosed on the corresponding tour page and home page card in compliance with National Association of REALTORS® (NAR) rules and Northwest Multiple Listing Service (NWMLS) distribution requirements. I hold a written agreement with every listing agent whose listing I discuss on this site.
